Native Law Statutes, Regulations and Treaties continues to bring together a timely consolidation of the significant statutes, regulations and treaties that have an impact on the area of native law. Additionally, this text contains helpful finding tools, including a detailed master table of contents, a table of contents for each statute and a comprehensive key word index, which simplify research.

New material for this year's edition includes:
  • Specific Claims Tribunal Act, S.C. 2008, c. 22 is now in force. This legislation creates a tribunal with power to adjudicate specific claims and make awards up to $150 million.
  • Bill C-5 An Act to amend the Indian Oil and Gas Act was introduced in the House of Commons on 28 January 2009. Bill C-5 replaces almost all of the provisions of the six-section Indian Oil and Gas Act and includes a number of matters that are currently provided for in the Indian Oil and Gas Regulations, 1995.
  • Bill C-8 Family Homes on Reserves and Matrimonial Interests or Rights Act was re-introduced on February 2, 2009 in the House of Commons and it was given first reading. The bill addresses issues relating to family real property on reserves by providing that a First Nation has the power to enact laws relating to “the use, occupation and possession of family homes on its reserves and the division of the value of any interests or rights held by spouses or common-law partners in or to structures and lands on its reserves” Where a First Nation does not have such laws in force, whether established under the bill, under the First Nations Land Management Act, or under a self-government agreement, provisional federal rules established in the bill will apply.
  • Two special statutes have also come into force relating to First Nations in the Vancouver area: the Tsawwassen First Nation Final Agreement Act S.C. 2008, c. 32, and the Musqueam Reconciliation Settlement and Benefits Agreement Implementation Bill, S.B.C. 2008, c. 6 (an Act of the B.C. Legislature).
