  • Consolidated Fastfrate Inc. (2007), 2007 CarswellAlta 1010, 2007 ABCA 198 (Alta. C.A.), leave to appeal allowed (March 6, 2008), Doc. 32290, 2008 CarswellAlta 291, 2008 CarswellAlta 29 (S.C.C.) The fact that it arranged to regularly hire a railway to physically transport freight did not change its service to its customers nor change the customers’ perception of it being a national enterprise within federal jurisdiction as undertaking under s. 92(10)(a) of the Constitution Act, 1867).
