They include amendments to the Code which: establish a new regime for the detection and investigation of drug-impaired driving; increase the mandatory minimum sentences for impaired driving and "driving over" simpliciter; increase the maximum sentence for such offences in summary proceedings to 18 months' imprisonment; make "driving over" causing death and "driving over" causing bodily harm strictly indictable offences subject to the same maximum penalties as their impaired driving counterparts; introduce parallel penalties for failing and refusing to comply with a demand for bodily substances in circumstances involving death and bodily harm; impose a reverse onus on certain repeat offenders in dangerous offender proceedings; double the recognizance period under ss. 810.1 and 810.2 for certain repeat offenders; and add to the list of conditions that can be imposed under those sections.
    • Sentencing amendments (the majority of which came into force on October 1, 2008) include those which: clarify the application of penalties for impaired driving offences; allow for the delay of sentencing proceedings so that an offender can participate in an approved treatment program; double the maximum fine in summary proceedings; permit the suspension of a CSO or probation order pending appeal; and authorize the forfeiture of property used in child luring upon conviction of that offence.
  • Other significant amendments include those which clarify the application of trial language provisions and require the translation of documents upon application by the accused and those which re-classify possession of break-in instruments as a hybrid offence.
The Pocket Criminal Code also includes a comprehensive Index, a Table of Contents, a Concordance for each statute, and the Forms of Charges from The Police Officer’s Manual for the main Criminal Code offences and for offences under the Controlled Drugs and Substances Act, the Firearms Act and the Youth Criminal Justice Act.
